The Contaminated Sites Act 2003, has been introduced to formerly identify and mange contaminated sites in Western Australia.

The key aspect of the CS Act is the mandatory reporting of known or suspected contaminated sites by people including:

An owner or occupier
A person who caused, or contributed to the contamination

Failure to report sites can result in large fines for individuals (up to $250,000) and companies (up to $1.25 million). It should be noted that an environmental consultant is not required by legislation to report a site as being contaminated or potentially contaminated.

Once a site has been reported, the DEC will classify the site based upon the risk posed to human health and the environment. There are seven possible classifications:

Report not substantiated
Possibly contaminated – investigation required*
Not contaminated – unrestricted use
Contaminated – restricted use*
Contaminated – remediation required*
Remediated for restricted use*
Decontaminated

Some of the important outcomes of specific classifications are outlined below.

Sites marked with an asterix, will have memorials registered on their Certificate of Titles.
Information on sites classified as ‘contaminated – remediation required’, ‘contaminated – restricted use’ and ‘remediated for restricted use’ will be registered on the publically listed Contaminated Sites Database.
Only sites classified as ‘contaminated– remediation required’ have to be cleaned up.
The CS Act establishes a hierarchy for assigning responsibility of remediation, and allows for the transfer of that responsibility.
